Terms and Conditions

1. Services

This agreement outlines the terms and conditions for photography and videography services provided by Mitcham Media to the Client. The specific services included will be detailed in a separate quotation provided to the Client.

2. Client Responsibilities

The Client agrees to provide clear and accurate instructions regarding the desired deliverables.
The Client is responsible for obtaining any necessary permits or permissions for locations or activities involved in the shoot unless otherwise agreed during quotation.
The Client agrees to be present and available at the agreed-upon times for the shoot.
The Client is responsible for providing any necessary props, models, or other elements required for the shoot.

3. Payment

Payment terms will be specified in the quotation and are due upon completion of the project.

Late payments will be subject to a 0.5% late fee per week.

4. Deliverables

Final deliverables will be provided in the format and quantity specified in the quotation.
Delivery timeframe will be determined and communicated to the Client.
The Client will have 5 working days to request minor revisions to the final deliverables.

5. Ownership and Usage Rights

Unless otherwise stated in writing, Mitcham Media retains all copyright and intellectual property rights to the photographs and videos.
The Client is granted a non-exclusive, non-transferable license to use the deliverables for their own personal or business purposes as outlined in the quotation.
Any commercial use of the deliverables beyond what is specified in the quotation requires written permission from Mitcham Media and may incur additional fees.

6. Cancellation and Refunds

Cancellations must be made in writing at least 7 calendar days prior to the scheduled shoot date.

Cancellations within 7 calendar days of the shoot date will result in a cancellation fee of 25% of the agreed-upon fee.

7. Limitation of Liability

Mitcham Media is not liable for any loss or damage to personal property belonging to the Client during the shoot.
Mitcham Media is not liable for any consequential or indirect damages arising from the use of the deliverables.

8. Dispute Resolution

Any disputes arising under this agreement will be settled through:

​i. Mediate: Try resolving issues with a neutral mediator (shared cost) within 2 weeks.

ii. Court: If unresolved, go to the High Court of England and Wales.

9. Entire Agreement:

This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Miscellaneous

These terms and conditions constitute the entire agreement between the parties and supersede any prior or contemporaneous communications.
Mitcham Media reserves the right to modify these terms and conditions at any time.
